The Ontario Human Rights Commission (OHRC) has published a lengthy document on Vaccine mandates and proof of vaccine certificates to coincide with new directives issued by the Province.
The OHRC’s position is that a person who chooses not to be vaccinated based on personal preference does not have the right to accommodation under the Code.
There have been no decisions that support a singular belief against vaccinations or masks that amount to a creed within the meaning of the Code.
The Commission maintains the “duty to accommodate” can be limited if it would significantly compromise public health and safety – such as during a pandemic.
