A former Arnprior resident will spend 3.5-years behind bars for sexual assault related offences dating back almost 50-years.
This afternoon (May 25th, 2021), Justice Adriana Doyle imposed a 43-month sentence for 75-year-old William also known as “Bill” Kirby.
Kirby was found guilty of sexual assault, indecent assault, pointing a firearm, common assault and assault on November 30th of 2020.
The charges stem from two victims and date back to the early 1970’s.
The crown was seeking a 52 month sentence with the defense asking for three to five years.
The sentence imposed by Justice Doyle will be less 71-days for time spent in custody before sentencing (47-days credited at 1.5-days each).
The judge noted an extreme pattern of domestic violence involving two former intimate partners.
In addition to time spent in jail, Kirby will be also added to the sex offenders registry, have to provide DNA and be prohibited from using firearms.
Kirby was also in court this morning for another set of charges he is facing.
Back on March 25th, 2021, Kirby was found guilty of kidnapping, aggravated assault and for issuing threats to cause death or bodily harm.
Those charges stem from an incident involving a third victim that was kidnapped in September of 2018, taken out to a wooded area in McNab/Braeside and stabbed once in the stomach and once in the neck.
Kirby was charged with attempted murder, but was not convicted.
A victim impact statement was read to the court this morning.
In the impact statement the victim said for the last 2.5-years they’re always looking over their shoulder, afraid to live alone, carry a panic button with them, sleep with a light on and are worried when an unknown vehicle stops in front of her house.
The victim impact statement highlighted fears for security with the victim telling the court she didn’t want to be another statistic like the Borutski women.
Despite having a no-communication order, Kirby directed the majority of his final statements to the victim, expressing his condolences for her parents passing and saying he was “very sorry that her neck is still sore”, but added they both know how that happened.
Kirby told the court he has also had a bad two and a half years and admitted he learned a lot about the way court works.
Kirby did not show any remorse for the victim, nor was there any indication he has taken any counselling or steps towards rehabilitation.
The crown is seeking a five year sentence with the defense is requesting three to five years in custody.
Justice Martin James who is overseeing the kidnapping trial and aggravated assault trial will sentence Kirby at 10:00am on June 22nd.
